ALERT TO ALL TEXAS MCSEs AND CNEs
(and other networking professionals
whose certifications use the term "engineer")

The Texas Board of Professional Engineers has apparently decided to begin enforcing an obscure provision of the Texas Engineering Practices Act which prohibits anyone not licensed by the Board from using the term "engineer." At least one MCSE received notification that he was in violation of the Board's regulations and was ordered to "cease and desist," and threatened with civil and criminal penalties if he didn't comply.

The good news is that a similar battle has already been fought, and won, by Novell in Illinois.  The court there held that the vendor-specific certification title did not violate that state's statutes making it against the law to use the title if not licensed by the professional engineering board.

The other good news is that Microsoft is aware of the problem and is dedicated to working to ensure that use of the title "Microsoft Certified Systems Engineer" is not endangered.

Nevertheless, it is important that we, as Texas certified computer networking professionals, join together to make our legislators aware of this problem.   MCSEs, CNEs and systems engineers with certifications from other vendors have worked hard to earn those titles.   This action by the Board could turn out to be a good thing, if it serves as a catalysts to bring certified professionals together, and results in clarification of the applicability of this section of the Act.
